ORDER 1. This is first application under section 439 CrPC for grant of bail in connection with Crime No.1316/14 registered at P.S. Kotwali for the offence punishable under section 354D/34 of IPC and section 11(1)/12 of POCSO Act. 2. According to prosecution, on 20.9.2014 petitioner and othe two co-accused persons chased the prosecutrix and advanced indecent remarks and gestures. 3. Learned counsel for petitioner submits that petitioner has no criminal antecedents. He is in custody since 14.10.2014. Co-accused Munna has been released on bail by this Court on 14.11.2014 in MCrC No.9059/2014. The trial will take considerable time to conclude, in such circumstances petitioner be released on bail. 4. Learned Government Advocate submits that allegations are serious and objectionable. 5. In response, learned counsel for petitioner submits that no evidence has been collected regarding any physical assault. Accused persons and prosecutrix are neighbours and report has been lodged as a result of some communication gap and misunderstanding. 6. After due consideration, I am of the view that this is a fit case for granting the bail. Thus, the application is allowed and it is directed that petitioner be released on bail subject to his furnishing personal bond to the tune of Rs.30,000/- (Rs.Thirty Thousand) with one surety in the like amount to the satisfaction of the trial Court for his appearance before the trial Court as and when directed.
