JUDGMENT Dharnidhar Jha,J: - Heard learned counsel appearing for the parties. 2. The petitioners are not named in the F.I.R. In fact, the informant was informed by one Brij Mohan Rai that the dead body of his son was lying North-South of a brick-kiln. He went there and saw the dead body and after 12 hours of getting the information and making the inquiries, he lodged the written report stating he suspected that some unknown criminals had murdered his brother. 3. Learned A.G.A. has placed the statement of one Virsu @ Virendra whose statement was recorded on 9.9.2013 in the case diary, i.e., on the fourth day of the dead body being located. 4. It appears from the post mortem examination report that the murder should have been committed somewhere in the vicinity of 2 p.m. on 6.9.2013 as the rigor mortis had yet to pass off from some of the lower limbs. 5. The submission was that in spite of the murder being committed probably in the broad-day light on the day on which the report was lodged, no one was being named and even the said Virsu @ Virendra, who is the solitary witness implicating the petitioners, was not coming forward to tell the names of the real culprits. 6. Regard being had to the submission and material on record, let the petitioners Raju Uraov, Virasa Uraov and Barava @ Vijay Uraov be released on bail on furnishing a bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ghazipur in connection with Case Crime No. 347 of 2013, under Section 302 I.P.C., Police Station Kareemuddinpur, District Ghazipur.
