JUDGMENT Hon'ble Dilip Gupta,J. According to the petitioner, there has been an encroachment on a public canal and road side land of Mohalla Bazarganj Saraitareen, in front of Sabjimandi, District Sambhal. 2. The Sub-Divisional Magistrate, Sambhal has, on 26 December 2013, issued certain directions to the Executive Officer, Nagar Palika Parishad, Sambhal (respondent no.4) for the removal of the encroachment, but the grievance is that no action has been taken. 3. In view of this, we direct the fourth respondent to personally carry out a verification of the alleged encroachments and thereafter to initiate necessary steps in accordance with law. We may clarify that all actions shall be taken after following due process including by furnishing a reasonable opportunity of being heard. The fourth respondent shall submit monthly reports to the District Magistrate, Sambhal (respondent no.3) in regard to the progress of the work of removal so as to enable the third respondent to monitor the situation and issue such appropriate administrative directions, as may be necessary. 4. The petition is, accordingly, disposed of. There shall be no order as to costs.
