ORDER 1. Heard on admission. 2. This is plaintiff’s second appeal directed against judgment and decree dated 24.1.2004 in Civil Appeal No.16 A/2000 passed by Additional District Judge, Sohagpur affirming the judgment and decree dated 12.5.2000 passed in Civil Suit No.11 A/1996 by Civil Judge Class I, Piparia. 3. Plaintiff having failed to establish that suit property marked as ABCD in the plaint map was the joint family property led the trial Court non suit the plaintiff in a suit for partition, declaration of title and for permanent injunction on a finding that the suit property was purchased by defendant vide registered saledeed on 25.8.1940. 4. There being a concurrent finding of fact as to the title and ownership of the property found to be in favour of defendant, no substantial question of law arises in absence of cogent material evidence to belie the concurrent finding of fact. 7.
