JUDGMENT Dharnidhar Jha, J: - Heard both sides. 2. The petitioner is the wife of deceased Rajendra Prakash Shukla and it is alleged that she in conspiracy with her three brothers, namely, Kamla Kant Tiwari, Hari Kant Tiwari and Shashikant Tiwari as also Amit Tiwari, son of one of her above named brothers, had committed murder of her husband by, firstly, beating him up and thereafter, hanging him so as to creating a defence that the deceased had committed suicide. The information has been lodged by the daughter of the deceased Rajendra Prakash Shukla. 3. It appears from the postmortem examination report that besides five abrasions and three contusions on different sizes lying over different parts of the body, there was a ligature mark around the neck measuring 32cm. x 1 cm. continuous and without any gap which was horizontal in position and it appeared that the ligature had caused the fracture of hyoid bone as a result of which he died. 4. The said informant has supported the case and the learned A.G.A. has drawn the attention of the Court to different paragraphs of the case diary to submit that the murder had been committed in the very house of the petitioner which fact has been supported by other persons also. One accused, namely, Atul Shukla who had been admitted to bail was not named in the F.I.R. and his name had appeared during investigation. 5. Considering the facts and circumstances of the case and considering the medical evidence, the prayer for bail of Smt. Kushum Shukla is dismissed.
