Vide letter dated 03.01.2014 addressed to the Secretary, Government of India, Ministry of Home Affairs, New Delhi, a request for handing-over the investigation of the case bearing FIR No. 139 dated 30.09.2013, was made to the Central Bureau of Investigation by the Department of Home Affairs and Justice, Government of Punjab. However, the said request after consideration was declined by the Central Ministry on the ground that the same does not have any interstate or trans-national ramifications as laid down in "State of West Bengal and others v. Committee for Protection of Democratic Rights, West Bengal and others" 2010(2) R.C.R. (Criminal) 141 : 2010(1) Recent Apex Judgments (R.A.J.) 664: (2010) 3 SCC 571 . Apparently, the State is hesitant to carry-out effective investigation on account of composition of the population of the town i.e. Malerkotla. Learned counsel for the petitioner informs that there is a complete polarization of the population in the town on the basis of religion. The State is not ready to earn the displeasure of either of the communities. 3. The intention of the State is very clear from the letter addressed to the Home Ministry. In the circumstances, this Court feels, even if the matter is handed-over to other branch like-Crime Branch of the State headed by the Director of Bureau of Investigation, the purpose of investigation is not likely to be fully achieved as being a State agency, it may also not put its heart and soul in the matter. 4. In the circumstances, this Court feels, even if the matter is handed-over to other branch like-Crime Branch of the State headed by the Director of Bureau of Investigation, the purpose of investigation is not likely to be fully achieved as being a State agency, it may also not put its heart and soul in the matter. 4. The State has taken contradictory stand, on the one hand the State has written to the Home Ministry for handing-over the investigation to the Central Bureau of Investigation and on the other hand, the State is claiming that Punjab Police is fully capable of investigating the present matter. 5. Allegedly, this is also to be noticed that prima facie the reasons for framing of the proposal to hand-over the investigation to the Central Bureau of Investigation by the State of Punjab is stated to be alleged lack of faith in the local police to carry out impartial investigation by the parents of the deceased, but in fact, it is very clear from the reply filed by the State that investigation is not being carried out for the obvious reasons i.e. not to earn the displeasure of either of the communities. 6. The matter pertains to the killing of a young boy in a very brutal manner. From the record, it emerges that the State of Punjab is hesitant to perform its duties of carrying out the investigation. The cries of the deceased cannot be allowed to go unheard. 7. In these circumstances, this Court feels that this is a fit case for investigation by the Central Bureau of Investigation. Accordingly, the matter is ordered to be handed-over to the Central Bureau of Investigation. As the incident is already more than 1= years, the Central Bureau of Investigation shall make an endeavour to expedite the investigation. The State is directed to hand-over the entire record pertaining to the present case to the Central Bureau of Investigation within three weeks from today. Disposed of, accordingly.
