ORDER 1. This first application under section 439 of CrPC for grant of bail has been filed by the petitioner. He is implicated in Crime No.450/2014 registered at Police Station Industrial Area, Jaora, District Ratlam for the offence punishable under sections 354 and 354A of IPC. 2. According to prosecution, on 18.10.2014, petitioner made an indecent assault and criminal assault on the prosecutrix, aged 18 years at hand-pump. 3. Learned counsel for the petitioner submits that petitioner is in custody since 9.10.2014 and this is first offence ever registered against the petitioner. Learned counsel further submits that in fact there had been a rivalry between the family members of the prosecutrix and the petitioner and report has been lodged on the basis of exaggeration of facts as a result of some communication gap. 4. Considering the aforesaid facts, in the opinion of this Court, this is a fit case for grant of bail. 5. Accordingly, it is directed that the petitioner shall be released on bail subject to his furnishing a personal bond in the sum of Rs.30,000/- (Rupees Thirty thousand only) with one surety in the like amount to the satisfaction of the concerned JMFC/CJM for his appearance before him or trial Court on all dates of hearing as may be fixed in this behalf by the Court concerned during trial. 6.
