JUDGMENT Hon'ble Abhinava Upadhya, J. Heard learned counsel for the petitioner. Shri Ajay Kumar Sharma has put in appearance on behalf of respondent no. 3. Learned Standing Counsel represents respondents no. 1 and 2. 2. Pursuant to the order Government Order dated 22.3.2003 it is claimed that the petitioner was entitled to promotional pay scale upon completion of 22 years of service. 3. The petitioner was an Assistant Teacher in the Primary School maintained and run by Basic Education Board. He retired from service on 30.6.2011. Since before his retirement he has been making efforts for promotional pay scale under Government Order dated 22.3.2003, but no heed was paid. 4. It is submitted that other similarly situated persons, who have also retired, have been granted promotional pay scale with retrospective effect, but the claim of the petitioner is not being considered. 5. The writ petition is disposed of with the direction to the respondent no. 3 to consider the claim of the petitioner in accordance with law and pass appropriate orders thereon. In case it is found that the petitioner is not entitled to promotional pay scale and the Government Order dated 22.3.2003 is not applicable upon the petitioner, reasons thereof would be communicated to the petitioner by passing a speaking and reasoned order. 6. With the aforesaid direction, the writ petition is disposed of.
