JUDGMENT Mr. Naresh Kumar Sanghi, J.: (Oral) - Prayer in this petition, filed under Section 439 read with Section 482, Cr.P.C., is for grant of interim bail for three months to the petitioner, Gursewak Singh, son of Gurbax Singh, resident of village Chahal Kalan, at present Plot No. 66, Gali No. 3, Antaryami Colony, Amritsar (presently confined in the Central Jail, Amritsar), who has been booked for having committed the offence punishable under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity, ‘the NDPS Act’), in a case arising out of FIR No. 79, dated 22.7.2012, registered at Police Station, Gharinda, District Amritsar Rural. 2. Learned counsel contends that the marriage of Manjot Kaur, daughter of the petitioner, is to be solemnized on 5.12.2014 at Himmat Mahal Palace, Ram Pura Road, New Kathanian, Amritsar. He further contends that on an earlier occasion, i.e. at the time of solemnization of the marriage of the son of the petitioner, he (petitioner) was granted the concession of ad-interim bail for five days by this Court vide order dated 4.2.2014, passed in CRM-M- 3328 of 2014. He further submits that the petitioner did not misuse the said concession and surrendered before the jail authorities within the stipulated time. He further contends that the petitioner has already suffered incarceration for two years and approximately four months and the trial is at the stage of prosecution evidence only. 3. Learned counsel for the State on instructions from ASI Savinder Pal of Police Station, Gharinda, District Amritsar Rural, submits that the aforementioned Marriage Palace has been booked for 5.12.2012 by the family member of the petitioner. 4. After hearing learned counsel for the parties and going through the material available on record, the present petition is allowed. The petitioner, Gursewak Singh, son of Gurbax Singh, resident of village Chahal Kalan, at present Plot No. 66, Gali No. 3, Antaryami Colony, Amritsar (presently confined in the Central Jail, Amritsar), is ordered to be released on ad-interim bail for a period of five days from 4.12.2014 to 8.12.2014 (both days inclusive), subject to his furnishing of bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Amritsar. The petitioner shall surrender before the Superintendent, Central Jail, Amritsar, on 9.12.2014 at 10:00 a.m. ---------0.B.S.0------------
