JUDGMENT 1. - This revision petition is preferred by the petitioner against the order dated 24.01.2014 passed by Judge, Family Court, Udaipur (hereinafter referred to as 'the Family Court') on an application preferred by wife of the petitioner under Section 125 Cr.P.C. for awarding interim maintenance to their minor daughter to meet the expenditure on her education. 2. After hearing both the parties, the Family Court has directed the petitioner to pay interim maintenance to the tune of Rs. 4000/- per month to the minor daughter. 3. Learned counsel for the petitioner has submitted that the wife of the petitioner is also earning Rs. 25,000/- per month, therefore, the Family Court has erred in directing the petitioner to pay interim maintenance to the tune of Rs. 4000/- per month to their minor daughter. 4. Per contra, learned counsel for the respondent has supported the impugned order. 5. Having heard learned counsel for the parties, this Court is of the opinion that before the Family Court, the petitioner has admitted that after all deduction, his monthly income is around Rs. 35,000/- and looking to this fact only, it cannot be said that the Family Court has erred in ordering for paying interim maintenance to the tune of Rs. 4000/- per month to the minor daughter of the petitioner. Hence, this Court does not find any merit in this revision petition and the same is hereby dismissed.Stay petition also stands dismissed.Revision petition dismissed. *******
