JUDGMENT Mr. Inderjit Singh, J.:- Prayer in the present application is for suspension of sentence of applicant-appellant Malkiat Singh during the pendency of appeal. 2. Learned Additional Sessions Judge, Sangrur, vide judgment of conviction and order of sentence dated 11.09.2013, passed in case FIR No.05 dated 13.01.2009, held the applicant appellant guilty for the commission of offence punishable under Section 307/34 IPC and accordingly sentenced him to undergo rigorous imprisonment for a period of ten years and to pay a fine of Rs.50,000/- under the aforesaid Section. 3. Feeling aggrieved against the said judgment of conviction and order of sentence, the applicant-appellant filed an appeal which has been admitted by this Court vide order dated 23.09.2013. 4. The applicant-appellant has already undergone more than five years of sentence out of ten years of sentence. He is in custody without any fault as the trial is going on since 2009. 5. The appeal is not likely to mature for hearing in the near future. Therefore, in the facts and circumstances, this petition is allowed and the sentence of imprisonment of applicant-appellant during the pendency of appeal shall remain suspended subject to his furnishing personal bonds and surety to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Sangrur.
