Judgment : 1. On 17.06.2014, this Court has passed the following orders : “The appeal has been filed in the year 2005, by the Managing Director, Tamil Nadu State Transport Corporation Limited, (Division-III), Kancheepuram, with the delay of 62 days. M.P.No.1 of 2006 has been filed for condoning the delay of 62 days. On this day, Mr. Lakshmipathy, learned counsel representing M/s. P.G. Padmanabhan, learned counsel on record, submitted that the entire case papers pertaining to the above appeal have been returned to the Transport Corporation with çhange of vakalath'. Registry is directed to verify as to whether any fresh vakalath has been filed on behalf of the appellant and if so, print the name of the learned counsel. If no vakalath is filed, Registry is directed to print the name of the Transport Corporation and delete the name of M/s. P.G. Padmanabhan and others. Post on 24.06.2014.” 2. After verifying the same, Registry has printed the name of the Managing Director, Metropolitan Transport Corporation Limited, (Division-I), Pallavan Salai, Chennai-2, in the cause list. Even today, there is no appearance for the appellant, either in person or through counsel. Hence, this Court is constrained to dismiss the Miscellaneous Petition for non-prosecution. Accordingly, this Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs. Consequently, connected Miscellaneous Petition is closed.
