JUDGMENT S. Manikumar, J, 1. There shall be an order of Interim Stay of operation of the Award, dated 28.01.2014 made in M.C.O.P.No.190 of 2013 on the file of Motor Accidents Claims Tribunal (Special Sub Judge), Coimbatore, on condition that the appellant -Insurance Company deposits the entire award amount with proportionate accrued interest and costs, less the statutory deposit already made in this Court, to the credit of M.C.O.P.No.190 of 2013 on the file of Motor Accidents Claims Tribunal (Special Sub Judge), Coimbatore, within a period of four weeks from the date of receipt of a copy of this order, failing which, the Interim Stay granted shall stand vacated automatically, without further reference to this Court. Notice. 2. On such deposit being made, the respondent/claimant is permitted to withdraw Rs.1,25,000/-(Rupees one lakh twenty five thousand only) with proportionate accrued interest and costs from the amount lying in deposit to the credit of M.C.O.P.No.190 of 2013 on the file of Motor Accidents Claims Tribunal (Special Sub Judge), Coimbatore, without furnishing any security. 3. There shall be an order of Interim Stay in respect of the balance amount. Learned counsel for the respondent/claimant submits that the matter may be referred to Lok Adalat for amicable settlement. Accordingly, the Registry is directed to post this matter before the Lok Adalat, after issuing notice to both the parties and their counsel.
