JUDGMENT 1. - Heard the learned counsel for the petitioner-State. 2. The petitioner State has challenged the order dated 09.05.2014 passed by learned Rajasthan Civil Service Appellate Tribunal, Jaipur, whereby the Tribunal has upheld the grant of pay fixation and pension to the respondent No.1 and thus, the pension was directed to be paid on the basis of his pay fixation at Rs. ,200/- as the same was sought to be lowered to Rs. 9, 0/- vide order dated 04.08.2000. The learned Tribunal has also rejected the objection raised by the petitioner State on the ground of delay in filing of the appeal by the respondent No.1. 3. Mr. K.D.S. Boparai, learned Dy. Govt. Counsel, appearing for the petitioner has urged that the pay fixation of the respondent No.1 was wrongly made and, therefore, that mistake was sought to be corrected vide order dated 04.08.2000. 4. Admittedly, no opportunity of hearing was given to the respondent No.1 before passing the order dated 04.08.2000 and even the representation filed by the respondent No.1 was arbitrarily and cryptically rejected vide order dated 14.11.2003 merely saying his case does not fall within the ambit of Rule 7 (1) of R.S.R. The petitioner does not appear to have been given any opportunity before passing the impugned order deciding the representation of the petitioner. In the opinion of this Court the order dated 09.05.2014 passed by the learned Rajasthan Civil Services Appellate Tribunal, Jaipur, therefore, cannot be faulted and no interference is called for. 5. The present writ petition filed by the petitioner State is found to be devoid of any merit and the same is, accordingly, dismissed. No costs. A copy of this order be sent to the concerned parties forthwith.Writ petition Dismissed. *******
