This Writ Appeal arises out of an order passed by a learned Judge in a writ petition filed by the Respondents 1 to 4 herein, directing the parties to settle their dispute relating to the grant of Patta, in a civil Court. 2. We have heard Mr. J.Lawrance. learned counsel appearing for the Appellant, M.Mahaboob Athiff, learned counsel appearing for the Respondents 1 to 4 and Mr. A.K. Baskarapandian, learned Special Government Pleader appearing for the Respondents 5 to 7 and 9. 3. The Respondents 1 to 4 herein filed a writ petition in W.P.(MD) No.16404 of 2013, challenging the order of the Revenue Divisional Officer dated 14.09.2013, ordering the subdivision of a land and directing the grant of patta in favour of the appellant herein. The said writ petition was allowed by a learned Judge of this Court, on the simple ground that a suit in O.S.No.144 of 2013 for a declaration of title and for injunction was already pending on the file of the District Munsif Court, Sivakasi. Aggrieved by the said order, the 6th Respondent in the writ petition is on appeal before us. 4. Prima facie, we find no wrong in the order of the learned Judge. As per the judgment of the Division Bench of this Court in Viswas Footware Company Ltd., v. The District Collector ( 2011 (5) CTC 94 ), the Revenue Authorities are obliged to keep their hands off when a suit for declaration of title and for injunction is pending. But unfortunately, the Revenue Divisional Officer ignored the pendency of the suit and proceeded to order the sub-division and grant of patta. Hence, the learned Judge was right in allowing the writ petition and directing the parties to have the dispute finally settled in the civil Court. 5. In view of the above, the writ appeal is dismissed. There will be no order as to costs. Consequently, lM.P.No.2 of 2014 is closed.
