JUDGMENT 1. Quantum of compensation of Rs.1,91,008/-awarded to the respondent/claimant, with interest @9% per annum, is the only challenge, in this appeal. 2. On this day, when the matter came up for hearing, Ms.Subathra, learned counsel for the appellant submitted that the entire award amount deposited to the credit of M.C.O.P.No.179 of 1999 on the file of Motor Accidents Claims Tribunal (I Additional District Judge), Krishnagiri, has been withdrawn. 3. Though appeal has been filed in the year 2005, with the delay of 5 days, the 1st respondent/claimant is stated to have expired, after expiry of the appeal. Steps have not been taken to implead the Legal representatives of the deceased. Considering the fact that the date of filing of this appeal, in the year 2005, this Court is not inclined to accept the same on two grounds: (1) Award amount has already been withdrawn and (2) Steps have not been taken to implead the Legal Representatives of the deceased. Hence, this Civil Miscellaneous Appeal is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
