JUDGMENT Hon'ble Arvind Kumar Tripathi (II), J. Heard learned counsel for the petitioner and learned Standing Counsel. With the consent of parties' counsel, the writ petition is being finally disposed of at admission stage. 2. Grievance of the petitioner is that the State is raising certain construction over the petitioner's bhumidhari land. 3. Right to acquiring of land in urban or village area both has been settled by this Court in a case reported in 2013 LCD 2048 Viresh Chandra and others versus State of U.P. and others whereby it has been held that the State or its authorities have no right to dispossess the citizens from their land or property without due acquisition in accordance with law. 4. Accordingly, the writ petition is finally disposed of with liberty to the petitioner to represent his cause to the competent authority who will adjudicate the controversy in the light of the aforesaid judgment of this Court expeditiously. 5. So far as the private respondent is concerned, we are not recording any finding nor interfering with their right, if any, with liberty to the parties to approach appropriate forum or prefer a suit. Subject to above, the writ petition is finally disposed of. No order as to costs.
