Judgment S. Manikumar, J. 1. While granting Interim Stay in M.P.No.1 of 2012 on 29.11.2012, this Court directed payment of Rs.4,00,000/- with proportionate accrued interest and costs, to the credit of MCOP No.271 of 2008, on the file of Motor Accidents Claims Tribunal (Fast Track Court NO.V), Tiruppur, Coimbatore, within a period of four weeks from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically. 2. On this day, when the matter came up for hearing, learned counsel for the appellant submitted that the entire amount has been deposited and he has no objection for permitting withdrawal of 50% of the amount deposited. 3. Considering the plight of the family, this Court deems it fit that it will be appropriate to permit the respondents/claimants to withdraw 50% of the amount with proportionate accrued interest and costs. Accordingly, there shall be a direction to the respondents/claimants for permitting withdrawal of Rs.2,00,000/-(Rupees two lakhs only) with proportionate accrued interest and costs, from the amount lying in deposit to the credit of MCOP No.271 of 2008, on the file of Motor Accidents Claims Tribunal (Fast Track Court NO.V), Tiruppur, Coimbatore, as apportioned by the Claims Tribunal, without furnishing security. Post on 17.07.2014 for final disposal.
