JUDGMENT 1. - The instant misc. petition has been preferred by the petitioner for quashing of the FIR No.56/2014 registered at the Police Station Luni, District Jodhpur for the offences under Sections 323, 341, 354B IPC and Section 7/8 POCSO Act, on the ground of compromise. 2. This Court on 24.9.2014 directed the Investigating Officer to verify the factum of compromise said to have been arrived at between the parties. 3. Today, learned Public Prosecutor has submitted a factual report dated 15.10.2014 as per which the Investigating Officer has verified the factum of compromise arrived at between the parties. 4. In this view of the matter and looking to the guidelines issued by the Hon'ble Apex Court in the case of Gian Singh v. State of Punjab & Anr. reported in JT 2012(9) SC-426 , it is apparent that further continuance of the proceedings in pursuance of the FIR impugned against the petitioner cannot be said to be expedient in the interest of justice. If the proceedings of FIR impugnged are allowed to continue, it may result into the compromise being unsettled. 5. Accordingly, the misc. petition is allowed and the FIR No.56/2014 registered at Police Station Luni, District Jodhpur and all proceedings pursuant thereto are hereby quashed. Stay petition is also disposed of.Petition Allowed. *******
