JUDGMENT Hon'ble Dilip Gupta, J. The petitioner seeks a direction to the Collector, Kaushambi, who is impleaded as the second respondent, to record the name of the Waqf over Plot No.708 situated at Village Rakshwara Pargana Karari, Tehsil Manjhanpur, District Kaushambi. 2. In this regard a remedy is available under Sections 33 and 39 of the U.P. Land Revenue Act, 1901. The record would indicate that the Collector has already been moved on 5 February 2014. The record further indicates that a similar request was also made by the Assistant Survey Commissioner of Waqfs on 31 October 2011 to the Sub Divisional Magistrate, Tehsil Manjhanpur, District Kaushambi. 3. In this view of the matter, we leave it open to the petitioner to pursue the application with reference to the provisions of sections 33 and 39 of the U.P. Land Revenue Act, 1901. The competent authority shall take an expeditious decision, after holding an enquiry as permitted in law with due notice to the affected parties. The petition is, accordingly, disposed of. There shall be no order as to costs.
