JUDGMENT Hon'ble Dilip Gupta, J. The petitioner, who has relied upon certain irregularities in the distribution of food-grains in district Etah, seeks a direction by this Court for transferring the investigation to the Central Bureau of Investigation. In this regard, reliance has been placed on a judgment of a Division Bench of this Court in Vishwanath Chaturvedi Vs. Union of India & Ors., 2010 (10) ADJ 504 (DB) in which the investigation was directed to be conducted by the CBI with regards to the districts of Ballia, Lakhimpur, Sitapur, Varanasi, Gonda and Lucknow. 2. In our view, before issuing any direction in the nature of mandamus, as is sought, it would be appropriate and proper to direct in the first stage that an inquiry be conducted by the Commissioner, Food and Civil Supplies in respect of the allegations which have been contained in these proceedings. The Commissioner, Food and Civil Supplies shall conclude the exercise no later than within a period of three months from the receipt of a certified copy of this order. Thereafter a decision in accordance with law shall be taken. We leave it open to the petitioner to move the Court after the conclusion of the inquiry by the Commissioner, Food and Civil Supplies, if the need so arises. The petition is, accordingly, disposed of.
