Judgment : 1. The petitioner seeks for a direction to the second respondent to measure the property (Match Box Industry) situated in New S.F.No.513/2H1A1 with suitable Surveyor. 2. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner is trying to agitate a civil right alleging that certain encroachments are being made. This dispute cannot be not gone into by the survey authority. 3. It is true that the Survey authority is not entitled to agitate the civil right. The grievance of the petitioner is that the petitioner owns a land and the patta stands in the name of the petitioner from 04.10.1996. The petitioner claims to be a holder of patta and tax receipts. In such a view, there may be a direction to the respondents to consider the petitioner's representation dated 29.01.2014 and pass appropriate orders on merits and in accordance with law as expeditiously as possible preferably within a period of six weeks from the date of receipt of a copy of this order. 4. With the above directions, the writ petition is disposed of. No costs.
