body2014
Judgment S. Manikumar, J. 1. Alleging that a marriage was performed on 22.05.2014 at Seventh Day Adventist Church, Moodradaippu, Tirunelveli District, by the Marriage Registrar, and further contending that the respondent No.3 has removed the custody of the alleged detenue K.Renuka, Writ of Habeas Corpus is sought for. 2. When the matter came up yesterday, the detenue was brought before this Court, we enquired the detenue. She submitted that she was not kept under illegal custody by the third respondent. However, the learned counsel for the petitioner insisted the matter be posted today as the petitioner was not available yesterday. Thus, the writ petition is listed today. Again, we enquired the alleged detenue and she has reiterated the same that she has not been tortured or kept in illegal custody by the respondent No.3 who is none other than her father. As the alleged detenue is aged about 23 years, and in the light of her statement stated supra, Writ of Habeas Corpus is not warranted. Hence, this Writ of Habeas Corpus is closed. 3. Though the learned counsel for the petitioner submitted that attempts are made to perform a second marriage, we are not inclined to delve into that aspect. It is open to the petitioner to work out his remedy known to law.
