Judgment S. Manikumar, J. 1. Alleging that the respondent No.5 has allegedly abducted her husband Yacoub @ Jacob and detained in illegal custody, the Writ of Habeas Corpus is sought for to produce him before this Court. 2. After several adjournments, the detenue is brought before this Court. We enquired the detenu. He stated that due to loss in business, he went away from his native place and now staying with his son at Chennai. He also submitted that he is not under illegal detention of respondent No.5. Submission of the alleged detenu is placed on record. 3. Mr. N. Mohideen Basha, learned counsel for the fifth respondent, against whom allegations have been made, prayed that suitable cost be imposed on the petitioner for unnecessarily roping him, in this habeas corpus petition. It is also his submission that when the petitioner made certain allegations, the office of the District Collector has enquired into that matter, wherein, she herself has deposed that due to loss in business, her husband went away. 4. In the light of the statement recorded supra, we are not inclined to delve into that aspect. However, it is open to the respondent No.5 to proceed in accordance with law, if he is so advised and desires to do so. As the detenu himself has stated that he is not under detention, the Writ of Habeas Corpus is closed.
