body2014
Judgment : S. Manikumar, J. 1. Father of the alleged detenue Akilandeswari (who is aged about 19 years) has sought for Writ of Habeas Corpus to produce her before this Court. 2. According to him, respondent No.3 has kidnapped and illegally detained her in a unknown place. Hence, a complaint dated 21.06.2014 has been lodged with the Inspector of Police, D-2 Sellur Police Station, Madurai City. A case in Crime No.619 of 2014 has been registered under woman missing case. As no action was taken, he has sought for a Writ of Habeas Corpus. 3. On this day, the alleged detenue Akilandeswari has been produced. When we enquired the alleged detenue, she has stated that she would live with the third respondent, as marriage has already been performed. However, the learned counsel for the petitioner submitted that the marriage is void as the respondent No.3 was less than the marriageable age, as per the Hindu Law. In a Writ of Habeas Corpus, we are concerned only with the case, as to whether any illegal detention has been made out. The writ petitioner has identified the alleged detenue. In view of the production of the detenue before this Court and inasmuch as she is a major, no further order can be passed in this petition. Hence, the Writ of Habeas Corpus is closed.
