Judgment : 1. The petitioner filed a petition seeking for transfer of investigation in Crime No. 99 of 2012 from the Inspector of police, K.Pudupatti Police Station, Thirumayam, Pudukkottai District, to C.B.C.I.D, Pudukkottai. 2. The learned Counsel appearing for the petitioner submits that on 22.10.2012 when the wife of the petitioner was carrying the jewels to the jewellery shop running by the petitioner, she was waylaid and the accused have taken the gold jewels and the silver articles. He further submitted that the third respondent had registered a case on 22.10.2012, but so far they have not recovered the stolen articles nor conduct the enquiry in a proper manner. He further submitted that the respondents 2 and 3 are not properly investigating the case. 3. The learned Government Advocate (Crl.Side) submits that the investigation is going in a proper manner and the Superintendent of Police, Pudukkottai District has also appointed a special team to recover the properties of the de-facto complainant. 4. Considering the submissions made by the learned Counsel appearing for the petitioner as well as the learned Government Advocate (Criminal Side)and considering the fact the the petitioner has made allegations against the respondents 2 and 3 the case need not be transferred to C.B.C.I.D. However, the Superintendent of Police, Pudukkottai District shall transfer investigation of the case Crime No.99 of 2012 on the file of the third respondent police to some other competent investigation officer and supervise the case for fair and speedy justice. 5. With the above direction, this Criminal Original Petition is disposed of accordingly.
