body2014
Judgment : 1. The petitioner seeks for a direction to direct the respondent to register and release the sale deed dated 16.06.2014 in respect of property situate in S.No.290/1A1 comprised in Patta No.2431 in Themmavur Village, Kulathur Taluk, Pudukkottai District on the basis of the petitioner's representation dated 23.06.2014. 2. The learned Counsel appearing for the petitioner submitted that the respondent namely the Sub-Registrar cannot question the title of the petitioner or his vendor and in this regard, the learned Counsel appearing for the petitioner produced a decision of this Court in Kannammal -vs- The Sub Registrar, Kachirappalayam, Chinnaselam Taluk, Villupuram District and others reported in 2013 (1) CWC 704 . It is to be pointed out that the petitioner is not aware of the reasons as to why the respondent has to refuse to entertain the document. Even in the representation given by the petitioner, the petitioner would state that no written reason has been given by the respondent for refusing to receive the document. 3. In such circumstances, it is too earlier to consider as to whether the respondent has adjudicated the title or to whether the decision referred supra could be applied to the petitioner's case. 4. In the light of the above, there will be a direction to the respondent to consider the representation of the petitioner dated 23.06.2014 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. 5. With the above directions, the writ petition is disposed of. No costs.
