Judgment 1. In this writ petition the petitioner seeks for a Writ of Mandamus to direct the respondents to call for an open tender to let out the Shop No.3 in Bus stand of Udangudi by providing an opportunity to the petitioner as claimed in petitioner's representation dated 16.01.2014. 2. The apprehension of the petitioner is that the respondents will allot the shop to certain interested person without conducting the public auction. 3. A counter affidavit filed by the third respondent stating that while steps have been taken for issuing of notification to call for open auction to allot the shop and due to announcement of general election, no notification has been issued for open auction. Now, that election is over and the model code of conduct is withdrawn, the respondent has no hesitation to offer the new shop to this petitioner, in case of his highest bid. 4. In the light of the stand taken by the respondents, there will be a direction to the respondents to conduct the public auction in respect of the said Shop by giving wide publicity about the same in the local Tamil newspaper having wide circulation in that area apart from the copy of the notification in the office of the Panchayat Board as well as in the Bus stand. Such auction shall be conducted within a period of three weeks from the date of receipt of a copy of this order 5. With the above directions, the writ petition is disposed of. Consequently, the connected Miscellaneous petitions are closed. No costs.
