Judgment : 1. In this writ petition, the petitioner is an elected Ward Member of T.Alangulam Village Panchayat. Though he made a complaint to the District Collector about the manner, in which, the third respondent, the President of the Panchayat has been functioning as alleged that the third respondent forged the signature of the Vice-President of the Panchayat. 2. Though the notice was served on the third respondent and the name is printed in the cause list, he has not chosen to appear either in person or through his Counsel. 3. Earlier, one of the petitioners by name R.Bose filed a writ petition in W.P(MD)No.8212 of 2012 and sought for a direction to consider the representation. This Court, by an order dated 22.11.2012, disposed of the writ petition by directing the first respondent to consider the representation within the stipulated time. Thereafter, an order was passed on 21.01.2013, withdrawing the cheque signing power granted to the third respondent. In spite of the directions, no action has been taken by the first respondent which necessitated the petitioner to approach the Court once more again. 4. Admittedly, notice issued on 28.05.2012 under Section 205 of the Tamil Nadu Panchayat Act, has not been withdrawn or dropped by the first respondent. In such circumstances, the first respondent is bound to proceed further in accordance with law. 5. Though prima facie, the first respondent, the District Collector, has not followed the order of this Court dated 22.11.2012, this Court does not wish to express any opinion and it would suffice to direct the first respondent to proceed in accordance with law pursuant to the notification dated 28.05.2012, within a period of eight weeks from the date of receipt of a copy of this order. 6. With the above directions, the writ petition is disposed of. Consequently, the connected Miscellaneous petition is closed. No costs.
