Judgment 1. The petitioner in this writ petition seeks for a direction to cut and remove the coconut tree standing in re-survey No.655/20B and hanging over and above the petitioner's house at Door No.13/12B at Re-survey No.655/20A of Manavalakurichi Village, Kanyakumari District. 2. By consent, the writ petition itself is taken up for final disposal. 3. Heard the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 4. On a perusal of the averments made in the affidavit filed in support of the writ petition, it is seen that the petitioner is aggrieved by the standing of the coconut tree in re-survey No.655/20B and hanging over and above his house at Door No.13/12B at Re-survey No.655/20A of Manavalakurichi Village, Kanyakumari District and the said coconut tree, at any point of time, may fall down which will cause eminent danger to the life of the family. Seeking to remove the above said tree, the petitioner sought for interference of the revenue authorities and submitted his representation dated 18.11.2013 followed by a reminder on 23.05.2014. 5. Since the petitioner claims that the tree is causing nuisance, in order to avoid any further problems in this issue, the second respondent is directed to consider the representation of the petitioner dated 23.05.2014 and pass appropriate orders, after issuing notice to the petitioner and the fourth respondent and try to resolve the issue amicably between the parties. The petitioner is directed to forward a copy of the representation along with a copy of this order to the third respondent. 6. The writ petition is disposed of with the above directions. No costs.
