Judgment : 1. The petitioner in this writ petition seeks for a direction to direct the respondent to grant permission to allow the bore well vehicle for erection of bore well in the petitioner company's land in Survey No.94/2 Sirumalai Village, Dindigul Taluk, Dindigul District. 2. The petitioner has submitted the applications on 13.06.2014 and 24.06.2014, seeking permission to take the bore well vehicle for the purpose of installing the bore well in the said land which according to the petitioner has been purchased by them pursuant to the auction conducted by the Debt Recovery Tribunal and in which a Sale Certificate was issued to the petitioner on 05.09.2012. Since the applications have not been considered and disposed of, the petitioner is before this Court. 3. By consent, the writ petition itself is taken up for final disposal. 4. Heard the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent. 5. It is not known as to whether any rival claim has been made. In the affidavit filed in support of the writ petition, the petitioner would state that they have to cross the reserve forest to reach the land and pass through the forest check post. Therefore, the petitioner sought for permission from the District Collector. 6. In the light of the above, without going into the merits of the matter, there will be a direction to the respondent to consider the petitioner's applications made on 13.06.2014 and 24.06.2014 and pass suitable orders on merits and in accordance with law within a period of three weeks from the date of receipt of a copy of this order. It is open to the respondent to call for a report from the District Forest Officer of the concerned area. 7. The writ petition is disposed of with the above directions. No costs.
