Judgment : 1. The petitioner seeks for issuance of a Writ of Mandamus to direct the respondents to consider the representation dated 24.06.2014 to enter into an agreement with the petitioner in respect of the Cable T.V business and also to refund the excess amount of Rs.62,653/- collected from the petitioner with 12% interest from the dates of collection or to adjust the same in the future billing. 2. By consent, the writ petition itself is taken up for final disposal. 3. Heard the learned Counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents. 4. The petitioner is carrying a Cable T.V.business under the name and style of Balamurugan Cables at Theni and he has enrolled himself with the respondent, Tamil Nadu Arasu Cable T.V. Corporation and he has been allotted the enrollment number LCO.37235. The petitioner has declared 350 points to his credit while enrolling his name and it is stated that the petitioner has been promptly paying the bills to the respondents. 5. The grievance of the petitioner is that the respondents collected an excess amount of Rs.62,653/- without assigning any reason. The further grievance of the petitioner is that the first respondent had suo-motto enhanced the number of subscribers from 350 to 438 during October 2012 and subsequently enhanced to 750 during May 2014. In this regard, the petitioner has submitted a representation to the respondents and since no action has been taken, the petitioner is before this Court. 6. The learned Special Government Advocate appearing for the respondents submitted that sufficient time may be granted to the respondents to consider the representation of the petitioner. 7. It is seen that the petitioner's representation in the form of a legal notice dated 24.06.2014, wherein, the petitioner has sought for the relief as referred to the above. In the light of the above facts, without going into the merits of the petitioner's representation, there will be a direction to the respondents to consider the representation of the petitioner dated 24.06.2014, and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. Before passing the order the first respondent shall call for report from the second respondent on the averments made by the petitioner in the representation. 8.
