Judgment S. Rajeswaran, J. 1. This is a petition filed by the petitioner, who is the alleged friend of the detenue, directing the respondents to produce the detenue Ms. E. Prathibhavathi, D/o. Ethirajan, aged about 22 years, before this Court. 2. On 14.7.2014, after hearing the learned counsel for the petitioner and the learned counsel for respondents 2 and 3-father and maternal uncle of the detenue and after confirming that there has been no relationship whatsoever between the petitioner and the girl/detenue, we are satisfied that only in the capacity of a friend, the petitioner has filed a petition before this Court. We find that there is absolutely no merit in the petition, and the petitioner has sought for production of the detenue, without any basis. Therefore, in the last hearing, we directed the petitioner to file an affidavit regretting for the mistake committed by him in filing this petition before the Court. 3. Accordingly, today, an affidavit to this effect has been filed before this Court by the petitioner. In para-3 of the said affidavit, the petitioner has stated as follows:- “3. I submit that I had filed the above Habeas Corpus Petition based on the letter written by the detennue before this Hon'ble High Court. I submit that I have not met the detenue after 20.11.2013 till date and I have not disturbed her. I undertake not to meet or disturb the detenue on my own.” 4. The said affidavit of undertaking filed by the petitioner before this Court is recorded and taken on file. The detenue's father is present before this Court. 5. In the light of the affidavit of undertaking given by the petitioner, this petition is closed as no further order is necessary in this petition. However, in the event of any disturbance being made by the petitioner to the family of the detenue or to the detenue herself in future, it is open to them to give a complaint to the concerned Police Station. On such complaint being made by the detenue, the concerned Station House Officer shall take action against the petitioner as per law.
