Judgment : Heard in-part. Mr. C.S. Vaidyanathan and Mr. Mukul Rohtagi, learned senior counsel appearing for the respondent-State (in WP(C) No(s).401 and 402 of 2013), pray for and are granted a week's time to file a sur-rejoinder to the rejoinder filed by the writ petitioners. Additional documents including details regarding the number of cases filed, sample copies of the charge-sheet filed so far as also the purchase value of the properties that are said to have been attached during the course of investigation, shall also be filed along with the sur-rejoinder. Respondent-State shall be free to approach the Shyamal Kumar Sen Commission of Inquiry set up by it for inspection of the records before the Commission, to collect any information considered relevant for the above purpose. Petitioners are also permitted to file additional document, if any, within three days from today with a copy of the same to counsel opposite. Mr. Siddharth Luthra, learned Additional Solicitor General, has, in answer to certain queries made by us filed responses from the CBI and also SFIO. He submits that the said responses may be kept in a sealed cover. Registry is is directed to do the needful. Mr. S.K. Bagaria, learned Additional Solicitor General, appearing for Directorate of Enforcement, Ministry of Finance, may also file a report in a sealed cover as to the progress made in connection with the on-going investigation undertaken by the Directorate. Mr. Bhargava V. Desai, learned counsel appearing for the SEBI who is respondents in both the writ petitions, shall also file his counter affidavits. For continuation of arguments post on Tuesday, the 4th March, 2014 along with W.P.(C) No.413 of 2013.
