JUDGMENT Hon'ble Arvind Kumar Tripathi, J. The present application under section 482 Cr.P.C. has been filed with the prayer to quash the Case No.9620 of 2012 under sections 323, 504, 506 IPC and under section 3/4 D.P. Act PS. Kotwali, District Mainpuri and further prayer is to stay the proceeding of aforesaid complaint case. 2. Heard learned counsel for the applicant, learned AGA for the State and perused the record. 3. It was informed by the parties that it is a matrimonial dispute and the matter has been settled and even the agreement has been filed before the court below. However, the same is still pending. 4. Learned AGA opposed aforesaid prayer. 5. Considered the submission of counsel for the parties and nature of allegation. 6. Since the matter has been settled between the parties, then no useful purpose would be served to continue the criminal proceedings, hence the proceeding of Case No.9620 of 2012 under sections 323, 504, 506 IPC and under section 3/4 D.P.Act PS.Kotwali, District Mainpuri is hereby quashed in view of the judgement of Apex Court in case of B.S.Joshi Vs. State of Haryana 2003(4)SCC Page 675 and Ghyan Singh Vs. State of Punjab 2012(10) SCC 303 and the present order passed by this Court. The interim order, if any, shall stand discharged. 7. In view of the above, this petition is allowed.
