JUDGMENT 1. - Present application has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in a case arising out of F.I.R. No. 823/2013, registered at Police Station, J.D.A. Jaipur Metropolitan City, Jaipur, for commission of offence punishable under Section 420 I.P.C. 2. The learned counsel appearing for the petitioner has submitted that it is alleged by the complainant that the petitioner having sold his plot by way of agreement to sell on 17.12.2012 to one Laduram had again executed an agreement to sell with the complainant on 18.06.2013 and had received Rs. 4,81,000/-, as an earnest money. 3. Counsel appearing for the petitioner has further submitted that in fact the petitioner had issued a cheque, which had bounced for which notice under Section 138 of the Negotiable Instruments Act has also been issued by the complainant. 4. Counsel appearing for the petitioner has submitted that the dispute, if any, is civil in nature. 5. After hearing the learned counsel for the parties, this Court is of the view that the petitioner is in judicial custody, as the period of Police remand is already over and it is a case of magisterial trial and trial will take a long time to conclude, hence, continuous detention of the present petitioner, as an under trial is not warranted. 6. Consequently, the present application is accepted and the petitioner is ordered to be released on bail during the pendency of the trial, to the satisfaction of the trial Court. *******
