JUDGMENT 1. The de-facto complainant is before this Court seeking a direction to transfer the investigation in Crime No.108 of 2014 on the file of the Kutralam Police Station, Tirunelveli to C.B.C.I.D, as the offence is a Cyber Crime. 2. According to the petitioner, the e-mail sent by the petitioner to the Bank for disbursement of amount was hacked by the culprits and the amounts were stealthily taken. When the petitioner came to know about that, immediately he lodged a complaint under Sections 420, 468 and 471 IPC and Section 66 of the Information Technology Act, 2000, since, no action has been taken by the respondent for lack of infrastructure, the petitioner is before this Court. 3. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) for the respondents. 4. Admittedly, the case has been registered under Section 66 of Information Technology Act, 2000, apart from the other offences. The matter relates to hacking of e-mail of the petitioner for payment to the others. Further, the said e-mail is said to have been hacked by the culprits. It is a Cyber Crime and which has to be investigated only by a Special team which is available only with the CBCID. If the investigation is not transferred to CBCID, nothing will be achieved by keeping the matter with the present police station. 5. In view of that, the case in Crime No. 108 of 2014 on the file of the Kutralam Police Station, Tirunelveli, is transferred to the first respondent namely C.B.C.I.D, for continuing the investigation. 6. With the above direction, the Criminal Original Petition is ordered.
