JUDGMENT Hon'ble Arvind Kumar Tripathi, J. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The present application under Section 482 Cr.P.C. has been filed with the prayer to quash the order dated 30.4.2014 passed by learned ACJM, XII Agra, District Agra in complaint case no. 462/2011, under section 138 N. I. Act, P.S. Etmaaddaula, District Agra and direct the court concerned to decide the case of applicant on merit. 3. Learned counsel for the applicant submitted that applicant is complainant. The complaint was filed under section 138 N. I. Act. The Advocates are on strike from 24.4.2014 to 30.6.2014. Apart from that they are continuously on strike on every Saturday for more than 10 years. The working started on 1.7.2013. Hence due to want of information regarding date applicant fail to appear before the court concerned hence complaint was rejected for want of prosecution on 30.4.2014. 4. Learned AGA opposed the aforesaid prayer. 5. Considered the submission of learned counsel for the parties. If notices are issued the matter would further delayed hence in the interest of justice, the order dated 30.4.2014 passed by learned ACJM, XII Agra, District Agra in complaint case no. 462/2011, under section 138 N. I. Act, P.S. Etmaaddaula, District Agra is hereby set aside. The applicant will file order before the court concerned within two weeks and the court concerned will proceed with the case, in accordance with law. 6. Accordingly, present application, under section 482 Cr.P.C., is finally disposed off.
