Judgment 1. By consent, the Writ Petition is taken up for final disposal at the time of admission itself. Mr.M.Rajarajan, the learned Government Advocate takes notice for the respondents 1 to 3. 2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3. 3. The petitioner seeks for a direction to direct the respondents 1 & 2 to conduct survey of his property in survey No.1076 of Kallimandayam Village, Oddanchathiram Taluk and a further direction to the third respondent to give necessary police protection to complete the survey. 4. According to the petitioner, he is absolutely entitled to the property in question and the private respondents have no jurisdiction to object the same. 5. Since the writ petition is disposed of without notice to the private respondents, the rival claims between the petitioner and the private respondents are not adjudicated in this writ petition. Further, it is seen that the petitioner has not given any representation to the respondents 1 & 2 with regard to survey of his land and straightaway, he prays before this Court for a direction to direct the respondents 1 & 2 to conduct survey of his property. Therefore, the prayer sought for cannot be granted. 6. In the light of the above, the writ petition is dismissed. However, liberty is given to the petitioner to give a fresh representation to the first respondent, along with a copy of this order. The first respondent, shall consider the same, after issuing notice to the respondents 4 & 5 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks thereafter. No costs.
