JUDGMENT Hon'ble Karuna Nand Bajpayee, J. This application under section 482 Cr.P.C. was filed before the learned Single Judge praying that "this Hon'ble Court may graciously be pleased to stay the further proceedings of Criminal Case No. 1816 of 2002, pending in the Court of CJM, Bijnor (State Vs. Amit Singh) under sections 147, 148, 149, 302, 323, 307 IPC arising out of case crime No. 220 of 2001, PS Mandawar, district Bijnor and to quash the non-bailable warrant against the applicant till Criminal Appeal No. 3360 of 2013 is pending before this Court and or may pass such other and further order as this Hon'ble Court may deem fit and proper under the circumstances of the case." 2. Learned Single Judge observed in his order dated 01.8.2014 that as the Division Bench consisting of one of us (Hon'ble Amar Saran, J) and Hon'ble Bachchoo Lal, J had passed an order on 31.7.2013 summoning the lower court record and it is not disputed that the record had indeed been received by the High Court, hence it was proper if the matter is placed before the said Bench, who heard the criminal appeal and the applicant may raise his grievance there. Thereupon, Hon'ble the Chief Justice passed an order dated 4.8.2014 for placing this matter before the Bench presided over by one of us (Hon'ble Amar Saran, J). 3. Heard learned counsel for the applicant and learned Additional Government Advocate. 4. We see no good ground to stay the aforesaid proceedings or to quash the impugned order issuing non-bailable warrant against the applicant. 5. However, we are of the view that the interests of justice would be met if the photocopy of the record be prepared and the same is sent to the trial court within a week, which shall be treated as secondary evidence of the contents of the record. 6. With the aforesaid observations, this application is rejected.
