Judgment 1. The petitioner's son Ranjith Kumar aged about 18 years is alleged to have been attacked by one Sundar of the same locality on 08.03.2014. Therefore, a complaint was given on 09.03.2014 which was registered under Sections 294(b) and 323 IPC. 2. The learned Counsel appearing for the petitioner would contend that the petitioner's son has undergone surgery in the spinal cord due to injury sustained by him in that attack, the case has to be altered under Section 307 IPC. Therefore, the petitioner is before this Court. 3. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Criminal side)n appearing for the respondents. 4. Taking into consideration that the Section 323 IPC has been altered into as 325 IPC after the investigation, the alteration of FIR as prayed for, cannot be granted. Hence, the Criminal original petition is dismissed.
