Judgment 1. Heard the learned counsel appearing for the petitioner and thelearned Government Advocate appearing for the respondent. 2. The petitioner seeks for issuance of a writ of mandamus to direct the respondent to issue challan for the purpose of payment of money towards the cost of the tender schedule, for item Nos.1 to 5 and 1 to 9 in tender notification dated 23.07.2014 in Na.Ka.A2/2574/2014 of the respondent forthwith. 3. According to the petitioner, the respondent is refusing to issue even the challan. 4. When the matter came up for hearing in the morning session, for enabling the learned Government Advocate to take instructions from the respondent, this matter was passed over. When the matter is subsequently taken up, learned Government Advocate, on instructions, submitted that the respondent will issue tender schedule on payment of requisite amount. 5. Recording the above statement made by the learned Government Advocate, the writ petition is disposed of with a direction to the respondent to issue challan to the petitioner for remitting the cost of the tender schedule and on producing the payment challan, the respondent will issue the tender schedule. Consequently, connected M.P.(md).Nos.1 & 2 of 2014 are closed. No costs.
