body2014
Judgment : 1. The plaintiff filed a suit in O.S.No.161 of 2001 before the learned District Munsif, Nagapattinam, seeking the relief of bare injunction. 2. In that suit, an application in I.A.No.336 of 2001 was filed seeking the relief of interim injunction. By order dated 02.08.2001, the Interim Injunction was granted till the disposal of the suit. This order was challenged in CMA.No.17 of 2001. By Judgment dated 12.02.2002, the Civil Miscellaneous Appeal was dismissed with costs. Challenging the dismissal, this Civil Revision Petition has been filed. 3. The suit itself is of the year 2001. Therefore, this Court deems it appropriate to direct the trial Court to dispose of the suit itself. The trial Court is directed to dispose of the suit on merits within a period of three months from the date of receipt of a copy of this order. 4. It is represented that while admitting the Civil Revision Petition, this Court has granted suspension of the order of injunction in CMP No.5714 of 2002. The order of suspension granted in CMP No.5714 of 2002 would remain extended for another three months i.e., till the disposal of the suit. With these directions, this Civil Revision Petition is disposed of. Consequently, connected Civil Miscellaneous Petition is closed.
