Judgment 1. The petitioner contends that the property is the ancestral property who purchased the same by way of a sale deed dated 02.05.1960. After the death of the parents, the petitioner only became the legal heir as the evidenced from the Legal Heir Certificate dated 28.12.1994. The patta, "A' Register and the Encumbrance Certificate also stood in the name of the petitioner. 2. When things stand so, the coconut trees which were standing on the property comprised in Survey Nos.498/1A, 499/2A, totalling 110 coconut trees, were cut by the accused namely Subramanian, Sekar and Balu. Though a complaint was given on 23.07.2014 and 02.08.2014, the respondent police has not registered any F.I.R. Hence, the petitioner is before this Court. 3. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents. 4. As stated above, the petitioner is the owner of the property. Moreover, after giving the complaint, the proposed accused moved anticipatory bail before this Court in Crl. O.P(MD) No.14354 of 2014 which was dismissed on 04.08.2014. 5. In view of that, there is no prohibition for the respondents to register a case and also to arrest the accused persons. Hence, the respondent police is directed to register the complaint and investigate the matter, including the arrest of the proposed accused. 6. With the above direction, the Criminal Original Petition is disposed of. For reporting compliance post on 14.08.2014.
