Judgment : 1. The daughter of the petitioner by name S.Fathima Rishmia joined the third respondent College for the course in Bachelor of Engineering. She was sponsored by the Government. The petitioner paid a sum of Rs.9,000/- towards fees. Thereafter, the student left the Institution on account of illness. Paragraph No.5 of the affidavit filed in support of the writ petition contains the reasons which made the daughter of the petitioner to discontinue the course. 2. The present prayer is to direct the third respondent to return the Transfer Certificate, SSLC Mark Statement, HSC Mark Statement, Community Certificate and Conduct Certificate to the daughter of the petitioner. 3. The third respondent filed a counter affidavit, wherein, it is indicated that the petitioner has paid only a sum of Rs.4,000/- towards tuition fees. According to the third respondent, the petitioner is liable to pay a sum of Rs.40,000/- as tuition fees along with a sum of Rs.7,000/- for text books. In short, the third respondent wanted one year tuition fees for issuing the Transfer Certificate etc., 4. The learned counsel for the petitioner, on instructions submitted that the daughter of the petitioner is still undergoing treatment and she is unable to join any of the other Institutions. 5. The daughter of the petitioner joined the third respondent Institution. She has studied there only for a period of three months. She left the institution on account of illness and she is stated to be continuing her treatment. The petitioner in paragraph No.5 of the affidavit very clearly stated that her daughter is now taking treatment. It is also her case that her daughter did not join any other Institution, after leaving the third respondent Institution. 6. In view of the pitiable condition of the petitioner, I am inclined to direct the third respondent to issue the Transfer Certificate and other documents to the petitioner. 7. The third respondent is directed to issue a Transfer Certificate indicating that the daughter of the petitioner was a student of the said Institution and she left the Institution in the first year. The Institution should also issue a Conduct Certificate to the petitioner. The other certificates such as SSLC Mark Statement, HSC Mark Statement, Community Certificate should also be returned to the petitioner by the Institution.

Such exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order. 8. The writ petition is disposed of with the above direction. No costs.
