Judgment : 1. The petitioner joined the second respondent Institution for the course of Bachelor of Engineering (Electronics and Communication Engineering) for the academic year 2013-2014. After attending two semesters, he left the institution. The petitioner, now seeks a direction to the second respondent to return his original Transfer Certificate and Conduct Certificate. 2. The learned counsel appearing for the Institution/2nd respondent, on instructions, submitted that the petitioner is liable to pay a sum of Rs.1,20,000/- being the balance fee for the remaining period. 3. There is nothing on record to show that the prospectus issued by the Management contained a statement that in case, the student is leaving the institution during the currency of academic year, he is liable to pay the fees for the entire term. 4. The learned counsel for the Institution, on instructions submitted that the Management is prepared to issue the Transfer Certificate and Conduct Certificate, without prejudice to their right to claim fees in the manner known to law. 5. The second respondent is directed to issue the Transfer Certificate and Conduct Certificate to the petitioner within a period of two weeks from the date of receipt of a copy of this order. I also make it clear that this direction would not stand in the way of the second respondent in claiming the fees legally, if they are entitled for balance fees. It is also made clear that there is no question of returning the Transfer Certificate produced by the petitioner. Since the petitioner has undergone two semesters, Transfer Certificate would be issued only by the second respondent.
