Ms. Ritu Bahri, J.: - This petition under Articles 226/227 of the Constitution of India is for issuance of writ in the nature of mandamus directing the respondent to receive the application for registration of vehicle of the petitioner and pass appropriate orders as per the Motor Vehicle Act, 1988 (for short ‘the Act’). 2. The petitioner is a permanent resident of District Rewari. He is practicing Advocate in the Punjab and Haryana High Court, Chandigarh since October, 2010 and residing in a rented house at Naya Gaon. The wife of the petitioner is also a Haryana Government employee and posted at District Panchkula. His son is studying in Chitkara International School, Sector 25-D, Chandigarh. 3. The petitioner has purchased a new vehicle i.e. SUV Renault Duster on 17.10.2012 vide sale invoice (Annexure P-2). A temporary registration certificate was issued, which was valid up to 16.11.2012 (Annexure P-5). However, the petitioner been orally denied by the office of the respondent to register his vehicle. A representation dated 17.11.2012 (Annexure P-7) has been made by the petitioner to the Vehicle Registration and Licensing Authority, Chandigarh, for registration of his new vehicle. 4. This petition, at this stage, is disposed of by giving a direction to the respondent to consider the averments made in the representation (Annexure P-7) and decide the same keeping in view the provisions of Section 40 of the Act within two weeks from the date of receipt of certified copy of this order. In case the petitioner satisfies the respondent that his place of business is in Chandigarh, the same shall be taken due note of in order to evaluate this fact as against the legal requirement contemplated in Section 40 of the Act.
