JUDGMENT 1. Learned Government Pleader is directed to take notice for Respondents 1 and 2. Sri Mallikarjun Basareddy, learned Advocate takes notice for Respondents 3 and 4. Heard. The grievance of the petitioner is that respondents 1 to 4 are not allotting shops formed in APMC Yard at Chadachan, though the sites were allocated in their names vide Annexure-'E'. 2. The records reveal that the Agriculture Produce Marketing Committee, Indi issued a notification as per Annexure-'A' dated 18.05.2013 for allotting certain shops formed in APMC yard Chadachan. Petitioners also filed applications seeking allotment. It seems the APMC, Indi has selected the petitioners as per the resolution Annexure-'E' dated 04.07.2013 for allotment of shops. According to the petitioners they have deposited the amounts as required by APMC and therefore there is no hurdle for the respondents to make the allotments finally in favour of the petitioners. 3. Sri Mallikarjun Basareddy, learned Advocate for respondents 3 and 4 submits that the papers may be pending consideration before respondents 1 and 2 for approval as required under Section 9(2) of the Karnataka Agricultural Produce Marketing (Regulation and Development) Act, 1966 and immediately after getting necessary orders, further process will take place. Sri Sharanabasappa K Babshetty, learned Government Pleader submits that if the petitioners are entitled to the sites in accordance with law, the same will be considered in accordance with law. The said submissions are recorded. 4. Since the petitioners are already selected for being allotted the sites in APMC Yard, Chadachan and since the petitioners are stated to have deposited the amounts with the respondent -APMC, the prayer of the petitioners shall be considered at an early date. The respondents are directed to consider the prayer of the petitioners for allotment of shops which are allocated to them under the resolution Annexure 'E' dated 04.07.2013, as per law, as early as possible, but not later than the outer limit of five months from the date of receipt of this order. With these observations, petitions stand disposed of.
