Judgment : M. Jaichandren, J. 1. This Writ Appeal has been filed against the order of the learned Single Judge, dated 31.01.2014, made in W.P.(MD) No.10506 of 2009. 2. The appellant herein is the petitioner in the Writ Petition, in W.P.(MD) No.10506 of 2009. The Writ Petition had been filed praying that this Court may be pleased to issue a Writ of Declaration, declaring the action of the respondent, denying the request of the petitioner to rectify the pay anomaly and stepping up his pay on par with his junior, Manoharan, as illegal. 3. The learned Single Judge had passed the order, dated 31.01.2014, stating that the petitioner is entitled to make a representation to the respondent setting out his grievance. On such representation being made, the authority shall consider the same and pass appropriate orders thereon, as per law. The appellant has filed the present Writ Appeal challenging the said order, passed by the learned Single Judge, stating that it would not help the appellant to get the relief, as prayed for by him, in view of the fact that an information has been received by him through his request made, under the Right to Information Act, 2005, stating that his claims have been correct. However, we are of the considered view that the appellant has no further reason to seek the setting aside of the order passed by the learned Single Judge, dated 31.01.2014. 4. In such circumstances, we find it appropriate to direct the appellant to make appropriate representation to the respondent, with regard to the fixing of his pay scale on par with his junior one Manoharan, within a period of fifteen days from the date of receipt of a copy of this order. On such representation being received, the respondent shall consider the same and pass appropriate orders thereon, within a period of four weeks thereafter. 5. The Writ Appeal stands ordered accordingly. Consequently, the connected miscellaneous petition, is closed. No costs.
