Judgment Dharam Chand Chaudhary, J. 1. Petitioner is one of the accused in FIR No.17/14, registered in Police Station Kumarsain under Sections 452, 323, 506 read with Section 34 IPC. 2. The allegations against him as disclosed from the record in a nut shell are that on 25.2.2014, he accompanied by his co-accused assaulted victim Anil Kapoor in his house at village Panevli, Tehsil Kumarsain, District Shimla and on hearing hue and cry, his mother Veena Devi, the complainant, entered in the room and made an effort to get her son free from the clutches of the accused-petitioner and his co-accused, she was also given beatings with sticks. The accused-petitioner has associated with the investigation of the case and there is no complaint in this behalf. Nothing is to be recovered from him. He being local resident, this Court see no reason of his fleeing away from justice or not available for the purpose of further interrogation, if required. I therefore, allow this petition and it is ordered that in the event of the arrest of the accused-petitioner in connection with FIR No.17/14, registered with Police Station, Kumarsain, he shall be released on bail, subject to his furnishing personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the arresting Police Officer/I.O., and shall further abide by the following conditions:- (a) He shall make himself available for interrogation as and when required and shall cooperate with the investigating Officer to conduct the investigation in a manner so as to take it to its logical end. (b) He shall not tamper with the prosecution evidence nor hamper the investigation of the case in any manner whatsoever. (c) He shall not make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or the Police officer. (d) He shall not leave the territory of India without the prior permission of the Court. 3. It is clarified that if the petitioner misuses his liberty or violates any of the conditions imposed upon him; the Investigating Agency shall be free to move this Court for cancellation of the bail. 4. The observations hereinabove shall remain confined to the disposal of this petition and have no bearing on the merits of the case. The application stands disposed of. Copy Dasti.
